Resumo
Numa vertente do Direito Comparado – microcomparativo, buscamos ofertar um enquadramento histórico constitucional dos Estados Argentina e Bolívia, para posteriormente, discorrer sobre os poderes dos chefes dos Estados em suas atuais Constituições. Primamos pela análise comparativa de como é a forma de Governo, poderes dos Chefes dos Estados e suas relações com os demais poderes, esclarecendo, as respectivas competências e limites. Apresentamos sínteses comparativas entre ambos chefes dos Estados, diferenças, semelhanças, confronto, avaliando e evidenciando conclusões críticas.
Abstract
Within a branch of Comparative Law (micro-comparative law), we seek to offer a historical constitutional framing of the Argentinian and Bolivian states in order to discuss the power of the heads of state according to their current Constitutions. We begin by a comparative analysis of their form of government, powers of the heads of state and its relation to the other powers, clarifying their respective competences and limits. We present comparative syntheses between both heads of state, showing their differences, similarities, conflicts, assessing and making evident critical conclusions.
